Can Family Members Get Mesothelioma Compensation?
Yes, family members can receive mesothelioma compensation through several avenues. Spouses and dependents can file wrongful death claims if a loved one passes away. Family members who develop mesothelioma from secondary exposure (such as laundering work clothes) may have their own personal injury claims. Caregivers may also be compensated for loss of consortium and emotional distress.
Wrongful Death Claims
When a mesothelioma patient passes away, surviving family members have the right to file a wrongful death lawsuit against the companies responsible for the asbestos exposure. These claims compensate the family for funeral expenses, loss of financial support, loss of companionship and guidance, and the emotional suffering caused by their loved one's death. Eligible family members typically include spouses, children, and in some states, parents and other dependents.
Wrongful death claims have their own statutes of limitations, which begin at the time of death. Acting promptly ensures your rights are preserved.
Secondary Exposure Claims
Some family members develop mesothelioma or other asbestos-related diseases through secondary (or "take-home") exposure. This occurs when a worker brings asbestos fibers home on their clothing, hair, or skin, exposing family members — most commonly spouses who laundered work clothes or children who had close contact with the worker. These family members can file their own personal injury claims for their asbestos exposure, separate from any claims filed by the original worker.
Courts in many jurisdictions have recognized the validity of secondary exposure claims, holding asbestos companies liable for the foreseeable harm to workers' families.
Loss of Consortium and Caregiver Claims
Spouses of mesothelioma patients may be entitled to loss of consortium damages, which compensate for the impact of the disease on the marital relationship, including loss of companionship, affection, and support. In some jurisdictions, caregiving family members can also recover compensation for the emotional distress of witnessing their loved one's illness and providing care.
These claims are typically filed alongside the patient's own mesothelioma lawsuit and are resolved as part of the same settlement or trial.
VA Survivor Benefits
For families of military veterans who died from mesothelioma, the VA offers Dependency and Indemnity Compensation (DIC) to surviving spouses and eligible dependents. VA survivor benefits provide a monthly tax-free payment and can be pursued alongside wrongful death lawsuits and trust fund claims without affecting either.
